1. Introduction

Welcome to HealthyHabitsToday ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our services for renting yachts and the website located at healthyhabitstoday.sbs, both operated by HealthyHabitsToday.

By reserving a yacht or utilizing our Service, you accept these Terms. Should you disagree with any section of these terms, you are prohibited from using the Service.

2. Service Overview

HealthyHabitsToday offers high-end yacht rentals, our services include, but are not limited to:

• Chartering yachts for a day
• Evening boat rides
• Retreats for businesses
• Privately organized gatherings
• Extended charter trips

Service availability is contingent upon several factors, including weather. We retain the right to alter or cease services without prior notice.

3. Booking and Reservations

3.1 Booking Process

To finalize a charter reservation, you must:

• Have reached the age of majority, typically 18 years
• Provide details that are precise and complete
• Make the required preliminary payment as indicated on the booking confirmation
• Consent to these Terms & Conditions

3.2 Confirmation

Confirmation of your booking is only complete once payment has been made and our official confirmation has been provided. We have the autonomy to reject providing services to anyone at our discretion.

3.3 Availability

Scheduling for charters is subject to both the availability of the vessel and suitable meteorological conditions. We strive to accommodate your requested dates and times as best as possible.

4. Payment Terms

4.1 Pricing

All our rates are quoted in $ and include all relevant taxes unless stated otherwise. Prices can be subject to change with no prior notice.

4.2 Payment Schedule

• Deposit: Half of the overall charter cost required at the time of booking
• Final payment: Must be settled 48 hours prior to the charter's departure
• Any additional charges: To be settled after the charter concludes

4.3 Payment Methods

Payments can be made through major credit cards, electronic bank transfers, and certified cheques. We use secure, encrypted platforms for processing payments.

5. Cancellation and Refund Policy

5.1 Customer Cancellations

• More than 72 hours before departure: Full refund less processing charges
• Between 24 to 72 hours before departure: A refund of 50%
• Under 24 hours before departure: No reimbursements will be given

5.2 Weather Cancellations

In cases where the captain deems weather conditions to be unsafe, you will be offered either:

• A rescheduled date for your charter at no additional cost, subject to availability
• A full refund if it's not possible to reschedule

5.3 Mechanical Issues

Should there be any mechanical problems with your designated yacht, we will endeavour to offer an appropriate alternative. In the event that an alternative isn't available, a full reimbursement will be issued.

6. Safety and Conduct

6.1 Safety Requirements

All guests must:

• Comply with all directions given by the crew
• Utilize safety gear as needed
• Inform us of any health conditions that could impact safety
• Stay within the assigned areas on the vessel

6.2 Prohibited Items

The items listed below are prohibited on the yacht:

• Bottles made of glass
• Illegal substances
• Firearms or any weapons
• Pets (except if permission has been obtained beforehand)

6.3 Conduct

Passengers are expected to behave in a civil manner. Should passenger conduct create safety concerns or disrupt other guests' experience, we reserve the right to end the charter prematurely and without a refund.

7. Liability and Insurance

7.1 Our Liability

Our liability is confined to charter fees paid. We are not answerable for:

• Injuries to oneself due to personal negligence
• Theft or destruction of personal belongings
• Indirect or punitive damages, as well as consequential losses
• Delays due to weather or circumstances beyond our reasonable control

7.2 Insurance Coverage

We have marine insurance covering our vessels and operations comprehensively. All passengers should ensure they have personal travel and possessions insurance.

7.3 Assumption of Risk

Participating in our yacht charters means you understand marine activities come with inherent danger, and you accept personal responsibility for your safety and actions.

8. Modifications and Itinerary Changes

We reserve the modification rights to itineraries, routes, or schedules subject to changes in weather, safety, or operational necessities. We aim to offer suitable alternative experiences whenever possible.

9. Force Majeure

We shall not be held responsible for delays, changes, or cancellations stemming from circumstances outside our reasonable control, which include, but are not limited to:

• Adverse weather
• Natural calamities
• Legal regulations
• Port Authority closures
• Unforeseen equipment malfunctions

10. Privacy and Data Protection

Your private data is collected and processed according to our Privacy Policy. By using our service, you give consent for the collection and utilization of your information as outlined in the Privacy Policy.

11. Intellectual Property

All the content on our website is owned by us, including text, designs, logos, and images, and is protected under copyright and trademark laws. Reproduction, distribution, or the creation of derivative works is not permitted without our explicit consent.

12. Governing Law

The governing laws of US Virgin Islands apply to these Terms. Any related disputes will be settled in the judiciary of St. Thomas, US Virgin Islands.

13. Changes to Terms

We may revise these Terms as necessary. Updates will be indicated on our website with the date of revision. Continuing to use our services indicates agreement with the revised terms.
